Market Access and Commercial Operations Counsel – Director or Senior Director

This rapidly growing biopharmaceutical company is highly motivated to find a Market Access and Commercial Operations Counsel to join their team. Reporting to the Commercial and Healthcare Compliance Counsel, you will support the US Market Access team and advice on healthcare and regulatory laws.
This is an excellent opportunity if you are a lawyer with 5-8 years of experience in a law firm advising biotech or pharmaceutical clients and you’re looking to move in-house. This also suits you if you’re an in-house counsel in the pharmaceutical industry and looking to make a move. They are ideally looking for a late August start date.
Responsibilities:
- Advise on fraud and abuse laws and regulations, including Anti-Kickback Statute, False Claims Act
- Advise on antitrust laws and regulations, including Robinson-Patman and Sherman Act
- Advise on FDA regulatory law, including the Food Drug and Cosmetic Act, for strategies and tactics related to commercialization
- Advise market access clients on discount, rebate/price concession strategies, government pricing, copay/patient assistance programs, policy development, risk mitigation, etc.
- Draft, negotiate and review market access-related agreements, including PBM agreements, GPO agreements, Specialty Pharmacy agreements, wholesaler agreements, discount and rebate agreements, distribution agreements, innovative/value-based agreements, market research agreements, vendor agreements, and service agreements
- Review promotional and educational materials for Market Access content
- Assist organization with drug transparency laws and government price reporting obligations and the impact of pricing or contracting proposals on reported government prices
- Assist Compliance in the development of company policies and procedures
Qualifications:
- Juris doctor and admitted to the bar
- 4+ years of experience in-house or at a law firm
- Knowledge of US Federal and state laws and regulations relating to the pharmaceutical industry, including without limitation, the False Claims Act, the Anti-Kickback Statute, fraud and abuse matters and competition laws.
- Experience drafting, interpreting, and negotiating complex Market Access related contracts.
- Strong understanding of pricing and reimbursement in the U.S pharmaceutical marketplace
- Knowledge of Medicaid Drug Rebate Statute, Veterans Health Care Act, Average Sales Price, and 340B program.
- Broad experience in an emerging, publicly traded company environment is a plus.
